Common Causes of Chelsea NYC Uber Accidents

Uber accidents are caused in the same way as all other motor vehicle accident types: by and through the acts of negligence. A lot of the times, the party who is negligent is one of the Uber drivers involved – either the driver of the Uber vehicle or the driver of the adverse vehicle.

Common acts of driver negligence that cause Uber crashes in Chelsea, NYC include:

  • Speeding;
  • Failing to yield;
  • Following too closely/tailgating;
  • Driving while distracted;
  • Driving while impaired; and
  • Failing to adhere to traffic safety laws and regulations.

While driver negligence is one of the most common causes of Uber accidents in Chelsea, NYC, it is not the only one. Other things that can cause or contribute to the risk of an Uber accident include:

  • Passengers’ Actions. Uber passengers can sometimes be unruly, especially if the reason that they are calling the Uber is due to the fact that they are intoxicated. A passenger’s behavior may increase the risk of an Uber accident, or even be the cause of the Uber crash in some instances.
  • Defective vehicle parts. Vehicle manufacturers and distributors have a duty to ensure that vehicles are in safe condition. If a defect exists, the vehicle may be dangerous. Defective tires, brakes, ignition devices and malfunctioning airbags are all common causes of Uber accidents in Chelsea, NY and/or injuries to Uber passengers.
  • Bad road conditions in Chelsea, NYC. Finally, although things like bad weather may be out of human control, other causes of dangerous road conditions, such as potholes, a lack of proper signage, or debris in roadways for a long period of time are not. Often times, the City of New York is responsible for ensuring that roads are maintained in the proper condition.

Who Will Pay Your Chelsea, NYC Uber Claim?

One of the most complicated things about being involved in an Uber accident in Chelsea, NY is determining who will pay your Uber accident claim.

Who will pay for the Uber crash depends on two main things: who was at fault for the Uber accident in Chelsea and which insurance policy applied at the time that the accident occurred

Consider the following with respect to which insurance policy will apply assuming the driver of the Uber vehicle was at fault:

  • If the driver was on the way to pick up a passenger or had a passenger in the car: If the accident occurred while the Uber driver was en route to pick up a passenger or while the driver had a passenger within the car, then Uber’s insurance policy will apply. Uber has $1,000,000 in third-party liability coverage.
  • If the Uber driver has the app turned on and is waiting for a ride request: If the driver is not on the way to pick up a passenger and is not carrying a passenger but logged into the app and awaiting a ride request when the accident happens, then Uber’s third-party liability insurance will apply if the driver’s personal insurance does not. Limits are $50,000 in bodily injury coverage per person and $100,000 per accident, and also $25,000 in property damage liability coverage per accident.
  • If the Uber driver is using the rideshare vehicle for personal use: If a driver is not signed into their rideshare app and is instead using their vehicle for personal use, then that driver’s personal insurance, which is mandatory in our state, will apply.

Of course, there can be the situation where the Uber driver isn’t at fault for the happening of the crash. Where this is the case, the insurance company of the at-fault party will likely be responsible for paying for the pain and suffering you endured as a result of the accident.
