Millions of Dollars Recovered for Our Clients

HARLEM CONSTRUCTION ACCIDENT ATTORNEY

Construction & Labor Law Accidents

Our New York construction accident lawyers know the difficulties a construction worker faces after being severely injured on the jobsite. Whether a plumber, electrician, cement worker, mason, drywall installer or any other tradesman, an injury stops them dead in their tracks from continuing to work and provide for themselves and their families. Construction accidents can often result in debilitating injuries, such as amputations, severe head trauma and death. In addition to physical injury, victims of construction accidents may also be forced to deal with mounting financial difficulties, such as lost wages and expensive medical bills.

New York Labor Law 240(1)

Commonly known as the "Scaffold Law," New York Labor Law 240(1) provides financial protection to construction workers who have suffered height-related injuries from falls. The Labor Law puts strict liability – meaning that liability is imposed regardless of fault – on the property owner and general contractor when a tradesman suffers an injury because of a fall from height or is hit by a falling object. By placing strict liability on general contractors and property owners, the Labor Law provides construction workers compensation for damages for almost all height-related falls, strikes and the resultant injuries. Therefore, construction workers who have suffered height-related injuries should seek the advice of an attorney with experience handling lawsuits involving falls from heights at construction sites.

New York Labor Law 241(6)

Construction workers who are injured on the job can file a Complaint in Court pursuant to New York Labor Law 241(6) if they were injured working on a construction site. Property owners, general contractors as well as subcontractors must follow rules and laws that are in place to protect them. It is not necessary for the contractors or property owners to know that the rule or law has been violated.

Compensation Available

When someone suffers an injury at a construction site, they should be able to recover financial compensation for their injuries. The following are usually recoverable:

Lost Wages: When a construction worker is hurt on the job, they go from making a nice living to having no money at all coming in and the spigot is essentially closed. Injured workers can seek damages for loss of earning capacity and job retraining if the injury does not allow them to continue with their craft.

Medical Bills: Sky-high medical bills can accumulate quickly especially if insurance does not cover all of the bills. A filed lawsuit can provide compensation especially if procedures or surgeries had to performed on a lien basis.

Pain & Suffering: Additional compensation is also available for pain and suffering sustained due to the injury sustained on the construction site.

Injuries that may be Sustained

  • Fractured bones
  • The necessity of numerous surgeries
  • Depression and the need for treatment
  • Traumatic brain injuries (TBI)
  • Neck and back injuries
  • Nerve damage
