By placing strict liability on general contractors and property owners, the Labor Law provides construction workers compensation for damages for almost all height-related falls, strikes and the resultant injuries. Therefore, construction workers who have suffered height-related injuries should seek the advice of an attorney with experience handling lawsuits involving falls from heights at construction sites.

New York Labor Law 241(6)

Construction workers who are injured on the job can file a Complaint in Court pursuant to New York Labor Law 241(6) if they were injured working on a construction site. It is not necessary for the contractors or property owners to know that the rule or law has been violated.

NEWS- December, 2020: Two builders involved in a 2019 construction accident in Harlem that killed a worker, Carlos Olmedo Lala, had their builder licenses permanently revoked. The accident had happened at 880 St. Nicholas Avenue, Sugar Hill. The decedent had been installing and repairing the building’s brick facade before he fell to his death. Department of Building’s records reveal that the contractors never obtained the required permits to install the scaffolding which did not have the proper safety devices such as guardrails and planks to support workers, such as the decedent.
