New York State Labor Laws

For that reason, there are specific laws that protect construction site workers in event of an unfortunate accident.

N.Y. Labor Law 200

N.Y. Labor Law 200 requires employers to provide safe work conditions for construction workers. It requires that places, where it is applicable, “shall be so constructed, equipped, arranged, operated and conducted as to provide reasonable and adequate protection to the lives, health and safety of all persons employed therein or lawfully frequenting such places. All machinery, equipment, and devices in such places shall be so placed, operated, guarded, and lighted as to provide reasonable and adequate protection to all such persons.”

N.Y. Labor Law 240

Sometimes called the “scaffolding law,” NY Labor Law §240 requires that workers who have to perform job duties at a height are provided with adequate fall protection. This law exists to protect workers from height-related risks, such as having to work on unsafe scaffolding or ladders and to prevent falls.

N.Y. Labor Law 241

NYLL §241 mandates that general contractors, owners, and other contractors ensure that workers are protected from exposure to safety hazards that may result in a serious injury. With this law, workers are given broad protections in all areas in which construction, excavation, or demolition work is being performed.
