Who Pays in an Uber Accident?

At this point, the majority of us have used Uber at least once. Rideshare companies such as Uber are becoming more and more prevalent as they offer a service of great convenience. All you need to do is go on the app to request a ride and wait until you are picked up. It is simple and often a very affordable option. Just like any other vehicle on the road, however, Uber driver vehicles are not immune to auto accidents. If you are injured in an Uber accident, you will most likely be wondering about who will pay to cover your losses.

In a car accident, determining who is at fault is a critical element in who pays. This is because whoever is at fault, or, most likely, their insurance company, will pay for the damages caused by his or her negligent actions or inactions that led to the injury-causing car accident. This is true of Uber accidents as well. There are, however, some nuances about who pays in an Uber accident that should be noted.

If you were an Uber passenger at the time of the accident and sustained injuries, you will likely have a potential claim against the at-fault party. Additionally, If a driver other than the Uber driver was responsible for causing the accident, then you will file your injury claim against that driver or his or her insurance company. If another driver was at-fault in causing the accident, the Uber driver also is likely to have a potential claim against that person. The Uber driver should, in this case, file a claim with the at-fault driver’s insurance company. Should the Uber driver be found at fault for causing the accident, then you will file your claim with Uber.

Should you have a potential claim to file with Uber because an Uber driver was at fault in causing a crash or the at-fault driver was uninsured or underinsured and UM/UIM coverage is needed, the amount of coverage will depend on the Uber driver’s status at the time of the crash. If the Uber driver was active on the Uber app, waiting for ride requests, then Uber’s liability insurance coverage will kick in in the amount of up to $75,0000 per person or $150,000 per accident in bodily injury insurance. If the Uber driver was on a trip with a passenger at the time of the crash, then another policy kicks in which provides up to $1.25 million in liability coverage for bodily injury and property damage and up to $1.25 million in SUM UM/UIM coverage should the at-fault driver fail to have adequate insurance limits or lack insurance altogether.
