Manhattan Rear End Accident Lawyer
Suffering from a car accident can be a stressful process. Nobody expects to have an accident while they are on the road, and few people know how to handle the situation appropriately. One of the most common types of automobile accidents is a rear end collision.
If you’ve been involved in a rear end accident you should hire an experienced attorney. Michael J. Redenburg is a top Manhattan rear-end accident lawyer. He has successfully handled many of these cases and understands what it takes to win your case. Get the compensation that you deserve by hiring a professional. You don’t want to risk a smaller settlement by handling your case on your own.
What Is a Rear End Accident?
A rear accident, much like it sounds, occurs when one vehicle collides into the rear of the other one. In most of these cases, the car hitting from behind is the one that is at fault. When you are driving it is your responsibility to avoid accidents at all costs. You should be following traffic signals, rules of the road, and drive as safely as possible.
If you run into the rear of another car, you likely weren’t paying attention while you were driving. You are supposed to keep enough distance between you and the car in front of you to avoid an accident. So, if you run into another car it is generally seen as your fault.
However, there are instances where you shouldn’t be at fault. If you are following a car that has malfunctioning brake lights, your accident may not be your fault. Although you saw that the brake lights didn’t work, it can be hard to prove. We recommend hiring a lawyer that concentrates in rear-end accidents to handle your case. An experienced attorney will thoroughly research your case to make sure that the right parties are held responsible. They will investigate the car and bring evidence against the at-fault party.
Why Do I Need a Special Attorney?
There are many lawyers that handle car accident cases, but few lawyers are familiar with certain types of accidents. When you are fighting for your settlement, you want to hire someone that is knowledgeable. If you hire someone that isn’t familiar with New York Traffic Rules and Regulations, you are putting yourself at a disadvantage. You need a lawyer that is well versed in these laws, so they can build you the strongest case possible. If you’ve been a victim of a rear end accident you are entitled to compensation. You should hire the best team possible to get you the settlement that you deserve.
How Do Rear-End Accidents Occur?
Just like with any other accident, a rear end accident occurs because of the negligence of a driver. As we mentioned earlier, you are required to keep a safe distance between you and other cars on the road. Even though the driver who crashes into the car in front of them is thought to be at fault, there could be several reasons why they aren’t. Below are some of the main ways that rear accidents occur:
- Tailgating or following too closely
- Driving while distracted. Especially while on a cell phone, texting, checking emails, eating, drinking or doing make up.
- Hazardous weather
- Speeding
- Unexpected stops
- Aggressive driving
- Mechanical failure
- And more
These are only a few of the many ways that you could be involved in a rear end accident. Ultimately, you need an experienced attorney that knows how to investigate the scene. You might think you know what happened in your accident, but we want to know for sure. So, if you’ve been a victim of a rear end accident, contact us today to discuss your options.
What Are the Injuries That Result From Rear-End Accidents?
Like any car accident, most of the parties involved sustain injuries. These injuries can vary from mild to severe, and they can even include death. Many victims involved in rear-end accidents suffer from whiplash and at most sustain broken bones. These minor fender benders are the complete opposite of serious accidents. On the interstate, however, rear end accidents can result in fatalities. You need a lawyer that can handle your rear end accident, regardless of the level of severity. We have handled rear-end accident cases where the person rear-ended has required fusion surgery such as cervical fusion and/or lumbar fusion surgery.

What Are the Causes of Rear-End Accidents?
As stated by the National Safety Commission, rear-end collisions account for 40% of the 6 million traffic crashes in the U.S. every year. A rear-end accident occurs every eight seconds. Common causes of rear-end collisions include:
- Tailgating: When a vehicle behind is following too closely, there is not enough distance to allow for a sudden stop ahead.
- Distracted driving: A driver who is texting, talking on the phone, eating, drinking, or applying makeup is not giving sufficient attention to operating the vehicle or the road ahead.
- Speeding: The faster a vehicle is traveling, the more time and distance is needed to stop.
- Driving under the influence: Alcohol and drugs can affect judgment, ability to process information, and reaction time in traffic situations.
- Drowsy driving: Sleep-deprived drivers are less attentive, react more slowly, and may fall asleep at the wheel.
Injuries Associated with Rear-End Accidents
Although occupants of both vehicles in a rear-end accident may be hurt, the driver and passengers of the front car usually sustain more serious injuries, as they are unprepared for the impact of the crash. According to the National Safety Commission, various injuries are common in rear-end collisions, including injuries to the:
- Head
- Face
- Spinal cord
- Neck Injuries
Rear-End Collisions and Whiplash
Whiplash is a neck injury common in rear-end accidents. It is caused by the “whip-like” back and forth motion of the head and neck in a crash. These quick motions can cause severe stress to the cervical spine. Symptoms of whiplash include:
- Neck pain and stiffness
- Reduced range of motion
- Neck instability
- Shoulder or upper back pain
- Lower back pain
- Headaches
- Tingling, weakness, or numbness radiating to the shoulder or down the arm
Have You Been Rear-Ended by Another Driver?
If you have been hurt in a rear-end collision caused by another driver, get medical attention for your injuries. Whiplash symptoms are sometimes delayed after a rear-end accident. Exchange information with the other driver, get contact information from any eyewitnesses and use your cell phone camera to take pictures of the scene. Then speak with an experienced personal injury attorney about recovering compensation for your injuries.
NEWS: July 24, 2023 10 people injured after minivan rear-ends MTA bus in the Bronx
EAST TREMONT, The Bronx — At least ten people were injured after a minivan rearended an MTA bus, police say.
It happened Sunday just after 7:15 p.m. on East 180th Street and Crotona Parkway. Police say the black minivan with TLC plates rear-ended the MTA bus, then the bus struck a four-door Nissan sedan. The minivan then caught on fire. Because the street was so full of people hanging out on a warm Sunday night, there were lots of people around to help the driver of the minivan, including the driver’s family. Neighbors say he drives a car service for seniors and people with disabilities and lives nearby. He did not have any passengers in the vehicle, but his own family members and friends came out to help and indicated that he may have had a seizure because he has a history of them. They also say he lost control of the car about five blocks away, and could not stop.
“Everybody thought he was dead, but he wasn’t. But thank God everybody was outside at the same time to get him out of that car. If that car was on fire, he would have been blown up or something. They said he came down from right there — from Family Dollar. That’s like five blocks. And you hit a car that hard, you see how the car was. All I saw was the car and smoke and everybody around the car,” said Jeremy Smith. The minivan driver was badly hurt. A few people on the bus were treated for less serious injuries. Three people in a sedan that the bus bumped into as a result also had minor injuries like neck pain. Police have not confirmed that the driver had any kind of medical episode, but they say no criminality is suspected and everyone is expected to survive.
